Terms of Service

These Terms of Service, together with our Privacy Policy, govern your use of the website, online ordering, in-store pickup, and DoorDash delivery services (collectively, the "site") operated by Discount Liquors, located at 252 North Ave, Dunellen, NJ 08812 (the "store," "we," "us," or "our"). By visiting the site or placing an order, you agree to be bound by these Terms and you represent that you are at least 21 years of age and the legal purchase age for alcoholic beverages in your jurisdiction. If you do not agree to these Terms, you may not access the site or use any of our services. These Terms are subject to change at any time without notice; continued use of the site after changes are posted constitutes acceptance of the revised Terms.

1. Account Creation and Registration

In order to place online orders, you must register for an account. This includes providing your name, phone number, email address, date of birth (to confirm you are 21+), and choosing a password. We do not currently offer guest checkout. You agree not to create an account or use the services if you have been previously banned from use of the services, or if you are under the legal purchase age.

2. Account Ownership and Security

You are responsible for maintaining the confidentiality and security of your account and password, and you are fully responsible for all activities that occur under your account. You may not allow others to use your account. You agree to (a) immediately notify us of any known or suspected unauthorized use of your account, password, or payment method, or any known or suspected breach of security; and (b) ensure that you sign out at the end of each session. We will not be liable for any injury, loss, or damage of any kind arising from or relating to your failure to comply with (a) and (b), or for any acts or omissions by you or anyone else using your account or password.

3. Age and Identity; Right to Refuse Service

By accessing the site or placing an order, you confirm that you are at least 21 years of age. A valid government-issued photo ID is required and will be verified at the point of in-store pickup, and at delivery by our third-party delivery provider. We reserve the right to cancel your order, to refuse to fulfill an order, to close your account, and to refuse service to anyone for any reason at any time, including but not limited to suspected intoxication, suspected use of fraudulent identification, inability to verify age, or violation of New Jersey alcoholic beverage control laws or local ordinances. Alcohol will not be sold or delivered to anyone under 21, visibly intoxicated, or otherwise prohibited from purchasing alcohol under applicable law. If we cannot verify your age at pickup or delivery, your order will be cancelled and payment authorization released; restocking or processing fees may apply.

4. Pricing and Availability

All prices are listed in U.S. dollars and are subject to change at any time without notice. Prices on our site may differ from prices in our retail store. We reserve the right, but are not obligated, to limit the sale of any product to any person, household, geographic region, or jurisdiction at any time in our sole discretion, and to limit quantities. All product descriptions, images, and pricing are subject to change without notice. We reserve the right to discontinue any product at any time. Any offer for any product is void where prohibited by law. In the event of a pricing error, we reserve the right to cancel the order and refund any amount charged.

5. Ordering, Payments, and Taxes

Payments are processed through Stripe, our third-party payment processor. We do not store or have access to your full credit card number. By submitting payment information, you authorize Stripe and us to charge the applicable amount to your selected payment method. You represent that you are the authorized user of the payment method and that all information you provide is true and accurate.

New Jersey sales tax and any other applicable state or local taxes will be calculated and collected at checkout. You are solely responsible for any other duties, taxes, levies, or fees imposed by any authority on you by virtue of your purchase. We are a New Jersey licensed retailer and sales are made and accepted at our Dunellen, NJ premises.

6. Pickup, Delivery, and DoorDash

In-store pickup. Orders placed on this site for pickup must be collected at 252 North Ave, Dunellen, NJ 08812 during business hours. A valid government-issued photo ID matching the order is required. Orders not picked up within 7 days may be cancelled and restocked.

Delivery via DoorDash. We do not deliver orders ourselves. Delivery is available only through DoorDash, a third-party delivery platform. When you choose to order delivery, you are leaving our site and placing your order with DoorDash, which is governed by DoorDash's own terms, conditions, fees, and privacy policy. We are not responsible for the acts or omissions of DoorDash, its drivers, or any other third-party delivery service, including but not limited to delays, damaged items, lost packages, mis-deliveries, age verification failures, or any conduct by delivery personnel. Any disputes related to delivery must be resolved with DoorDash.

7. Canceling and Changes to Orders

Once an order has been placed, changes are subject to our discretion and approval. You may request to cancel an order prior to fulfillment by contacting the store. Refunds for cancelled orders, where granted, will be issued to the original payment method through Stripe. Alcoholic beverages cannot be returned once delivered or picked up except as required by New Jersey law (for example, defective product).

8. Limited License; Personal Use Only

Subject to these Terms, you are granted a personal, nonexclusive, non-transferable, limited, revocable license (without the right to sublicense) to access and use the site for your personal, non-commercial use only. Our products are not intended for resale or wholesale distribution. Collection or "scraping" of our product listings, images, descriptions, pricing information, or any other data collection from the site is prohibited and is a violation of these Terms. You may not modify, copy, distribute, re-publish, transmit, display, perform, reproduce, publish, reuse, resell, license, create derivative works from, transfer, or sell any information, content, material, software, products, or services obtained from the site.

9. Reviews and User Content

You may be able to post reviews, photos, questions, comments, or other content on the site. This content must not be illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, contain software viruses or "spam," or impersonate another person or entity. We reserve the right to remove or edit any content you post at any time, but we are not obligated to review posted content. If you do post content, you grant us an irrevocable, royalty-free, worldwide, sublicensable right to use, reproduce, modify, publish, create derivative works from, distribute, and display such content, including the name you submitted in connection with the content.

10. Intellectual Property

All content offered on the site, including images, videos, text, graphics, logos, button icons, audio clips, digital downloads, data compilations, and software, is our property or the property of our content suppliers, and is protected by United States and international copyright, trademark, and other laws. By using the site, you acquire no rights or licenses in any of our or our licensors' intellectual property.

11. External Websites; Third-Party Links

The site may contain links to independent third-party websites, including DoorDash, payment processors, social media, and others. These links are provided as a convenience only. We are not responsible for the content, policies, products, or practices of any third-party website. We do not review, approve, monitor, endorse, warrant, or make any representations with respect to any third-party website. In no event will we be responsible for the information contained on, or your use of or inability to use, any third-party website.

12. No Warranty; "As Is"

THE SITE AND ALL PRODUCTS, SERVICES, INFORMATION, AND MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE MAKE NO REPRESENTATION OR WARRANTY REGARDING THE ACCURACY, ADEQUACY, RELIABILITY, AVAILABILITY, TIMELINESS, COMPLETENESS, OR SUITABILITY OF THE SITE OR ANY INFORMATION CONTAINED ON IT, INCLUDING PRODUCT INFORMATION, IMAGES, OR PRICING. WE MAY CHANGE OR DISCONTINUE THE SITE AT ANY TIME WITHOUT NOTICE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO THESE EXCLUSIONS MAY NOT APPLY TO YOU.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DISCOUNT LIQUORS, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, USE, PERSONAL INJURY, PROPERTY DAMAGE, DAMAGES FROM ANY SECURITY BREACH OR INTRUSION, OR ANY OTHER PECUNIARY OR NON-MONETARY LOSS, HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, ARISING OUT OF OR RELATED TO: (a) your use of or inability to use the site; (b) any products purchased through the site, including consumption or misuse of alcoholic beverages; (c) the acts or omissions of DoorDash, Stripe, or any other third-party service provider; (d) any unauthorized access to or alteration of your transmissions or data; or (e) any other matter relating to the site or these Terms.

IN ALL EVENTS, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE GREATER OF (i) THE AMOUNT YOU PAID TO US FOR THE SPECIFIC PRODUCT OR ORDER GIVING RISE TO THE CLAIM IN THE THIRTY (30) DAYS PRECEDING THE EVENT, OR (ii) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU TO THE EXTENT PROHIBITED BY LAW.

14. Assumption of Risk; Responsible Consumption

You acknowledge that the consumption of alcoholic beverages involves inherent risks, and you assume all such risks. You agree to consume alcohol responsibly and in compliance with all applicable laws, including but not limited to laws prohibiting the sale or furnishing of alcohol to minors, driving while intoxicated, and public intoxication. You agree not to provide alcoholic beverages purchased through the site to any person under the legal purchase age. We are not liable for any injury, loss, or damage resulting from the consumption or misuse of alcoholic beverages purchased through the site.

15. Indemnification

You agree to defend, indemnify, and hold harmless Discount Liquors and its owners, officers, employees, agents, affiliates, licensors, and suppliers from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including but not limited to reasonable attorneys' fees) arising from: (a) your use of and access to the site; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any intellectual property, property, or privacy right; (d) any claim that your user content caused damage to a third party; or (e) your furnishing of alcohol obtained through the site to any person under the legal purchase age or to any person in violation of applicable law. This defense and indemnification obligation will survive these Terms and your use of the site.

16. Promotional Offers, Credits, and Coupons

From time to time, at our sole discretion, we may offer promotions, coupons, credits, promo codes, or discounts (for example, online-only discounts). These offers are subject to cancellation or change at any time without notice, may have additional terms, and may differ between online and in-store. We do not offer gift cards.

17. Governing Law; Venue

These Terms and any dispute arising out of or relating to these Terms or your use of the site are governed by the laws of the State of New Jersey, without regard to its conflict of laws principles. You agree that any action at law or in equity arising out of or relating to these Terms or the site shall be filed only in the state or federal courts located in Middlesex County, New Jersey, and you consent and submit to the personal jurisdiction of those courts. Sales on this site are made by a New Jersey licensed retailer and are subject to New Jersey alcoholic beverage control laws and regulations.

18. Waiver and Severability

The failure to exercise or enforce any right or provision in these Terms shall not constitute a waiver of such right or provision. If any provision, or portion thereof, of these Terms is held by a court of competent jurisdiction to be invalid, illegal, void, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent necessary, and the remaining provisions of these Terms will continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the site and supersede any prior agreements or understandings, whether oral or written.
